1. The Agreement
1.1. You, the Client ("You") have agreed to engage Aideen Ni Riada ("We", "Our" or "Us") to carry out the services as set out ("the Services").
1.2. Our delivery of the Services will be subject to these Terms and Conditions ("Terms") and your signature confirms your acceptance and your agreement to abide by them.
1.3. Should you require additional services over and above the Services selected in your proposal then such support and/or services will be in addition to the Services agreed within these Terms and will be dealt with by way of separate agreement with separate terms and conditions and payment arrangements.
2. The Services
2.1. Delivery of the Services shall commence on the date of your invoice, or such other date as we agree in writing, and will continue until the Services have been delivered or the Agreement is terminated in accordance with these Terms, whichever occurs first.
2.2. We agree to deliver the Services with reasonable care and skill consistent with best practices and standards applicable in our professional marketplace and we agree to comply with all relevant regulations, guidance, standards and codes of conduct that apply or are relevant to the provision of the Services.
3. Your Obligations
3.1. You accept responsibility for attending sessions and putting what you learn into practice.
3.2. You accept responsibility for your results which depend on your starting point, the actions you take and your current circumstances.
3.3. You accept that as part of your use of the Services that it will be your responsibility to take feedback and learn new techniques to gain confidence in your voice.
3.4. You acknowledge that it shall be your responsibility to prepare for our sessions.
3.7. You agree to participate in kind feedback to others in group classes.
4. Payments Terms
4.1 You shall be responsible for ensuring that payment of the Fee, any installment / payment schedule of the Fee, or any other sum is paid in full and on time in accordance with the payment terms set out.
4.2. In the event payment is beyond 7 days overdue, then we shall be entitled to withhold delivery of the Services until payment has been made in respect of the outstanding amount.
4.3. In the event payment is beyond 30 days overdue then we shall be entitled to terminate this Agreement and instruct a collection agent or solicitor to seek recovery of the Fee along with interest and any accrued costs incurred in taking such action.
5. Personal Data
5.1. While using our service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“personal data”). Personally, identifiable information may include, but is not limited to:Email address
First name and last name
Phone number
Booking data also includes but is not limited to: address (for payment verification with Stripe).
5.2. You acknowledge that group classes are recorded. If you attend a group class and share a song or comment on another student then this is recorded and will be shared with other students. These recording are for your personal use only unless otherwise stated.
5.3 You acknowledge that participation in the Facebook Group and WhatsApp groups are a benefit that is free to you however we cannot guarantee that these services will be available indefinitely.
5.4 You agree that should you submit a testimonial that this may be used on all social media channels and websites owned by Aideen Ni Riada.
5.5 You agree that audio or video recordings may be taken of you should you participate in any public events either online or live and these may be used as promotional material unless you specify otherwise beforehand.
6. Refund Policy
6.1. You acknowledge that no refund policy shall apply to your purchase of the Services.
6.2. In light of our refund policy, no chargeback or threatened chargeback claims from your debit or credit card provider will be accepted. If you choose to pursue a chargeback claim without contacting us first then you accept you will be in breach of these terms and you agree to indemnify us for the repayment of any charges, costs or fees imposed by your debit or credit provider, or our merchant service provider or incurred by us.
7. Complaints or Concerns
7.1. In the event you have any concerns as to the delivery of the Services you agree to notify us of such concerns by email to info@confidenceinsinging.com as soon as possible and before taking any further action.
7.2. We agree that upon receipt of notification of such concerns that we shall arrange a meeting to discuss your concerns and we agree to use all reasonable efforts to work with you to resolve your concerns. For the purposes of these Terms, further action includes stopping payment or making any chargeback or similar claim.
8. Unforeseen Circumstances
8.1. If we need to cancel a class or course then an alternative date or services such as private sessions of the same value will be given.
